What is the EB-5 Immigrant Investor Program?

This is an immigrant investor visa program that allows qualified foreign investors to obtain lawful permanent residency in the U.S. by investing in a U.S. commercial enterprise and creating jobs. On March 15, 2022, the “EB-5 Reform and Integrity Act” was amended which created new requirements for the EB-5 immigrant visa category and the Regional Center Program.

What are the minimum qualifications for this program?

Investment Requirement

This program requires investors to make a capital investment in a new commercial enterprise. The investment amount varies based on the location of the investment:

  • $1,050,000 in most cases

  • $800,000 in Targeted Employment Areas (TEAs), which can be rural areas or areas with high unemployment

The applicant must prove the investment must:

  • create or preserve at least 10 full-time jobs for qualifying U.S. workers

  • demonstrate that the invested funds are legally sourced

  • place the investment “at risk,” meaning there is a possibility of gain or loss, similar to any business venture

  • for “Regional Center projects”, jobs can be created either directly or indirectly

  • for “non-Regional Center projects”, the jobs must be directly created by the new commercial enterprise

Investors can invest in various types of business entities, such as corporations, partnerships, and trusts. However, they can invest directly in a new commercial enterprise or through a regional center.

What does it mean a “Regional Center”?

What government entity administers this program and its investment requirements?

USCIS administers this program, and they adjust/ review the minimum investment requirements for the EB-5 program every five years. The next adjustment will become effective for new EB-5 applicants who submit an application on January 1, 2027, or afterward.
